Official Contest Rules & Regulations

1. The Food Connect Canada’s Great Recipe Search Contest (the “Contest”) is conducted by Food Connect Inc the “Sponsor”) and is open only to residents of Canada (excluding the province of Quebec), and also excludes employees of Food Connect, their respective affiliates, advertising or promotional agencies and, as applicable, all of their respective affiliated and associated companies and divisions, directors, officers, partners, franchisees, agents, successors, assigns, members of the immediate family (defined as mother, father, brothers, sisters, sons, daughters, and husband or wife, regardless of where they reside) or household of any of the above persons;
2. The procedures for entry and participation in the Contest are subject to these Contest Rules.
3. NO PURCHASE NECESSARY.
4. HOW TO PARTICIPATE: To enter contestants can register as a user at www.foodconnect.com and submit a recipe during the official contest period. All recipes submitted during the duration of the contest are eligible to win. Contestants can enter as many recipes as desired.
5. By participating in this contest, the finalist must agree that the Sponsor may use their name, picture/portrait likeness, for advertising and other purposes without further consideration, payment or notice in perpetuity. All concepts or ideas contained or embodied therein, become the sole property of the Sponsor and will not be acknowledged or returned. The Sponsor is not liable for any printing or production errors associated during the contest.
6. All submitted recipes will be posted on the Food Connect website. The Sponsor reserves the right to reject, disqualify, modify, edit, revise or take down any comment, photos, or any entry which the Sponsor, in its sole discretion, determines to be inconsistent with its standards, audience expectations, or reputational interests, or that the Sponsor believes may violate any applicable laws or interests.
7. HOW TO VOTE: The contest will be posted on foodconnect.com starting at or around 8:00am PST, January 16, 2008 and ending at or around 11:59 pm PST, April 30, 2008 unless terminated earlier in the sole discretion of Food Connect. Contestants recipes will be profiled online at the Food Connect website at www.foodconnect.com. All registered users can vote on each recipe. Limit of one ranking per recipe per registered users. Voters must complete all required fields of the online voting/ranking process in accordance with the online instructions. Votes/rankings submitted in accordance with those official Rules shall be hereinafter referred to as eligible votes. If a voter uses multiple e-mail addresses to submit more than one vote online, the first online vote will count. In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential voter may be requested to provide the Sponsor with proof that the potential voter is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of the Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, the Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the voting process, and to cancel, terminate, modify or suspend the Contest. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Contestants agree that in the event of a dispute, all the Sponsor’s decisions are final. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to voter's or any other person's computer related to or resulting from participation or downloading any materials in the Contest. The Sponsor is not responsible for late, lost, illegible, incomplete, stolen, or misdirected votes. Use of computer programs and other automatic means to vote in contest is prohibited.
8. CAUTION: ANY ATTEMPT BY ANY PARTY TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. CONTEST MAY BE DISCONTINUED IF THRE IS EVIDENCE OF HACKING OR OTHER TYPES OF SECURITY BREACHES. The Sponsor reserves the right in its sole discretion, to void any and all votes and/or entries of an entrant when the Sponsor believes the entrant has attempted to tamper with or impair the administration, security, fairness or proper play of this contest or website.
9. The Contest closes at 11:59pm on April 30, 2008 (the “Contest Closing Date”) unless terminated earlier in which case the earlier date shall be the Contest Closing Date. Votes/Rankings not received by the Contest Closing Date will be null and void.
10. PRIZES: On or about May 2, 2008 one Grand Prize Winner will be chosen by Food Connect, whose decisions on all aspects of the contest are final. Grand Prize Winner is determined by the total number of eligible votes cast for the contestants recipe during the contest period with an overall ranking of the recipe of 4 stars or higher. The finalist that receives the largest number of eligible votes during the contest period will be determined to be the winner. There is one (1) Grand Prize available to be won throughout Canada (excluding Quebec), at the outset of the Contest, consisting of an 8 Day Cruise for 2 passengers. The winner is responsible for any taxes or fees relating to their participation in the Contest.
11. Odds of winning the Grand Prize depend on the number of eligible votes cast. Grand Prize Winner selection will be made at 930 Seymour Street, Vancouver, BC, by the official Contest judge. The Contest judge will contact the eligible Grand Prize winners by contestant-provided email within 48 hours of the draw. If a selected entrant cannot be contacted within three (3) days of the draw or after being contacted, does not claim his or her Grand Prize on or before such date and time, or does not meet all of the Contest conditions, another entry will be selected from all remaining eligible entries. In order to win the Grand Prize, the winning party must correctly answer, unaided, a time limited mathematical skill testing question to be administered by telephone at a prearranged, mutually convenient time.
12. The right is reserved to terminate or withdraw this Contest at any time without prior notice for any reason whatsoever. The Sponsor also reserves the right to amend the Contest Rules at any time without any liability to any Grand Prize Winner or finalist.
13. The Sponsor reserves the right to change the structure of the Contest as they see fit.
14. This Contest is void where prohibited by law and is subject to all Federal, Provincial, and Municipal laws and regulations. The Contest and the terms and conditions contained within these rules shall be governed by and construed in accordance with the laws of the province of British Columbia, without giving effect to any principals of conflicts of law. Any action at law or in equity arising out of or relating to the Contest and these terms and conditions shall be filed only in the provincial or federal courts located in Vancouver, British Columbia, and by participating in the Contest, you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
15. RELEASES, ETC: The Grand Prize winner will be required to sign a Declaration and Complete Release and Waiver of Claims releasing the Contest Sponsors, their respective advertising and promotional agencies, the Contest judge – appointed by the Contest Sponsors, the affiliates of the foregoing and all of their respective directors, officers, owners, partners, employees, agents, representatives, advertising agencies, successors and assigns and any person or entity connected with the Contest or the Trip, and any of their respective parent companies, affiliates, subsidiaries, agents or representatives, (collectively, the “Releasees”) and acknowledge that the Releasees are not responsible for and are in no way liable for any injuries, loss or damages caused by: (i) the administration (including scheduling) of the Contest including any failure of transportation or inability for any reason to participate in the Trip; (ii) the Contestant’s or any third party’s participation in the Trip or events or activities on the Trip, or (iii) being selected or disqualified as a result of the decisions of the Contest Sponsors or the failure to participate in the photo shoot; or (iv) any printing, typographical or technological errors in any materials associated with the Contest from any liability in connection with the Contest or the Grand Prize;
16. No Winner will be permitted to participate in the grand prize without submitting to the contest sponsors a validly signed Release Form prior to the departure on the Trip. In the case of Individuals under the age of majority, they must have their legal guardian and/or parent sign the Release Form, releasing the Contest Sponsors from any and all liability.
17. MISCELLANEOUS: Prizes are non-transferable and must be accepted as awarded with no substitutions in cash or otherwise, except at the Sponsor’s sole discretion. The Sponsor reserves the right to substitute a prize or portion of a prize of equivalent monetary value if a prize or portion thereof cannot be awarded as described. The Sponsors will not be responsible, however, if weather conditions, event cancellations, or other factors beyond their reasonable control prevent a prize or portion thereof from being fulfilled. The prize will only be awarded to the verified winner. All decisions of the Contest judge and Sponsor are final in all matters relating to this Contest. The Sponsor and other Releasees will not be responsible for illegible, incomplete, postage-due, lost, misdirected, damaged or late prize claims, which will be void. All votes become the property of FoodConnect.com and will not be returned. No correspondence will be entered into except with prize claimants who are winners.
18. In the event of any dispute concerning the operation of any element of the Contest or these Contest Rules, the decision of the Sponsor will be final.
19. These Contest Rules are additional to and do not supersede any and all Release Forms signed by the Competitor and in the event of any conflict between any Release Form and these Contest Rules, the Release Form will prevail.
